This End User License Agreement ("Agreement" or "EULA") is a legally binding agreement between you ("User," "Player," "You," or "Your") and POLYGUNPLAY™ ("POLYGUNPLAY," "Company," "We," "Us," or "Our") governing your installation, access, and use of Bird Game: Tokyo™, including all updates, downloadable content, patches, software, online services, websites, digital content, and related materials (collectively, the "Game").
By downloading, installing, copying, accessing, or using the Game, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
If you do not agree to every provision of this Agreement, do not install, access, or use the Game.
POLYGUNPLAY grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one lawful copy of the Game solely for your personal, non-commercial entertainment.
This license does not transfer ownership of the Game.
All rights not expressly granted remain reserved by POLYGUNPLAY.
The Game is licensed—not sold.
POLYGUNPLAY retains all ownership rights, including all intellectual property rights, copyrights, trademarks, trade dress, artwork, code, software, music, sound effects, writing, designs, gameplay systems, user interface, graphics, characters, animations, models, textures, maps, logos, branding, and all related content.
Nothing in this Agreement transfers ownership to you.
You represent that:
You are legally permitted to enter this Agreement.
You comply with the laws of your country.
If you are under the age required by applicable law, you have permission from a parent or legal guardian.
You agree to use the Game only as intended.
You may not:
Reverse engineer the Game except where prohibited by law.
Decompile the software.
Disassemble the software.
Modify executable files.
Modify encrypted assets.
Circumvent security systems.
Remove copyright notices.
Remove trademarks.
Remove watermarks.
Bypass anti-cheat systems.
Create unauthorized servers.
Create unauthorized launchers.
Sell Game content.
Rent the Game.
Lease the Game.
Redistribute the Game.
Mirror downloads.
Resell activation keys.
Exploit bugs.
Abuse glitches.
Automate gameplay.
Use bots.
Use scripts.
Cheat.
Hack.
Inject code.
Use memory editors.
Use packet manipulation.
Use unauthorized software.
Interfere with multiplayer services.
Harass players.
Threaten players.
Impersonate developers.
Upload malicious software.
Attempt unauthorized access to Company systems.
If the Game permits user-generated content ("UGC"), you retain ownership of your original creations.
However, by uploading UGC you grant POLYGUNPLAY a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to:
Host
Store
Display
Modify
Adapt
Reproduce
Translate
Publish
Promote
Distribute
Solely for operating, improving, marketing, and supporting the Game.
You represent that you own or have permission to upload such content.
Online functionality may include:
Multiplayer
Matchmaking
Leaderboards
Statistics
User accounts
Cloud features
Community functions
Events
Online services may change, be interrupted, suspended, or permanently discontinued at any time without liability.
POLYGUNPLAY does not guarantee continuous availability.
POLYGUNPLAY may provide:
Patches
Bug fixes
Balance updates
Security updates
Gameplay adjustments
Performance improvements
Content updates
Updates may be required to continue using online features.
Some updates may significantly modify gameplay.
Any in-game items, unlockables, cosmetics, achievements, progression, statistics, currencies, or digital content remain the exclusive property of POLYGUNPLAY.
You receive only a limited license to use such content.
No virtual item has monetary value unless explicitly required by law.
POLYGUNPLAY permits individuals to create:
Gameplay videos
Livestreams
Tutorials
Reviews
Commentary
Walkthroughs
Educational content
Provided such content:
Complies with applicable law.
Does not falsely imply endorsement by POLYGUNPLAY.
Does not distribute Game files or paid content.
Does not circumvent purchase requirements.
Does not contain unlawful, defamatory, infringing, or otherwise prohibited material.
POLYGUNPLAY may revoke this permission at any time in the event of misuse or violation of this Agreement.
Unless expressly authorized by POLYGUNPLAY, modification of the Game is prohibited.
If official mod support is introduced in the future:
Mods remain subject to this Agreement.
Mods must not include unlawful material.
Mods must not infringe intellectual property rights.
Mods must not contain malware or harmful code.
Mods must not interfere with online services or security systems.
POLYGUNPLAY may disable or remove incompatible or prohibited mods at any time.
If you voluntarily submit:

Bug reports
Feature requests
Ideas
Concepts
Improvements
You grant POLYGUNPLAY a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, modify, commercialize, reproduce, publish, distribute, and otherwise exploit such feedback without compensation, attribution, or further permission.
The Game may incorporate third-party software, middleware, libraries, services, or open-source components.
Such components remain subject to their respective licenses.
Nothing in this Agreement limits any rights granted to you under applicable third-party licenses.
Your use of the Game is also governed by the POLYGUNPLAY Privacy Policy.
Where online functionality is used, certain information may be processed for multiplayer functionality, matchmaking, moderation, analytics, customer support, fraud prevention, security, and technical operation of the Game.
POLYGUNPLAY may suspend or terminate your license immediately if you:
Violate this Agreement.
Cheat.
Exploit vulnerabilities.
Distribute unauthorized copies.
Interfere with online services.
Infringe intellectual property rights.
Engage in fraud.
Abuse other users.
Engage in unlawful conduct.
Upon termination:
Your license immediately ends.
You must immediately cease using the Game.
You must uninstall or destroy all copies of the Game where required by applicable law.
Termination does not affect any rights or remedies available to POLYGUNPLAY under this Agreement or applicable law.
You acknowledge that the Game contains valuable intellectual property protected by copyright, trademark, trade dress, patent, trade secret, unfair competition, and other applicable laws.
Unauthorized copying, extraction, modification, reproduction, distribution, publication, commercialization, or other exploitation of any portion of the Game is strictly prohibited unless expressly authorized in writing by POLYGUNPLAY.
THE GAME IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLYGUNPLAY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:
Merchantability.
Fitness for a particular purpose.
Non-infringement.
Title.
Accuracy.
Availability.
Security.
Error-free operation.
POLYGUNPLAY DOES NOT GUARANTEE THAT:
The Game will be bug free.
The Game will operate without interruption.
The Game will meet your expectations.
Defects will always be corrected.
Servers will always remain online.
Data will never be lost.
Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYGUNPLAY SHALL NOT BE LIABLE FOR ANY:
Indirect damages.
Incidental damages.
Special damages.
Consequential damages.
Exemplary damages.
Loss of profits.
Loss of saved data.
Loss of goodwill.
Business interruption.
Computer failure.
Device damage.
Account loss.
Virtual property loss.
Other economic damages.
ARISING FROM OR RELATED TO THE GAME, EVEN IF POLYGUNPLAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE LIABILITY CANNOT BE EXCLUDED, LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless POLYGUNPLAY and its owners, employees, contractors, licensors, successors, and affiliates from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from:
Your violation of this Agreement.
Your unlawful conduct.
Your misuse of the Game.
Your infringement of third-party rights.
You agree to comply with all applicable export control, sanctions, and trade laws governing the Game.
This Agreement shall be governed by the laws applicable in the jurisdiction where POLYGUNPLAY is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.
If any provision of this Agreement is found unenforceable, invalid, or otherwise ineffective, such provision shall be limited or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
This Agreement, together with any incorporated policies including the Privacy Policy, Terms of Service, Community Guidelines, Acceptable Use Policy, and DMCA Policy, constitutes the entire agreement between you and POLYGUNPLAY regarding the Game.
This Agreement supersedes all prior agreements, communications, and understandings concerning its subject matter.
POLYGUNPLAY may revise, update, or modify this Agreement from time to time.
The updated version becomes effective upon publication or as otherwise communicated by POLYGUNPLAY.
Continued use of the Game after revisions become effective constitutes acceptance of the updated Agreement.
